A WORD ABOUT
TERMINOLOGY:

For anyone
who is beginning or is well
on their way in their
journey with metal, crystal
or any type of activity that
would be considered mining,
please be aware that the
terminology you use effects
how the mining laws effect
you. The term "Recreational
Prospector" does not apply
to prospecting, and says to
authorities that you are not
a serious prospector, and
are not covered by the
mining laws, which only
apply in 19 of the 50
states. The terms you
need to be using to identify
your activity include; small
mining operator, minerals
prospector, professional
prospector and terms that
indicate you are
engaging in
activity for profit not
pleasure. |
The mining laws do not cover you if
your activity is only for
pleasure. We use the term
"Recreational" as a search term ONLY
so you can find us better. HOOKED ON
GOLD is engaged in prospecting
activities FOR PROFIT. We also engage
in activities that will assist you
in your successful pursuit of
prospecting for profit.

PROSPECTOR'S and DETECTORIST'S CODES OF ETHICS
Many of
you may not be aware that there is a
prospectors or a metal detectorists
code of ethics. Many of these codes
deal with common sense ways to
respect the land and other people's
property. However, they do bear
repeating. For your benefit we
present them here. Please abide by
them. Those of us who have
prospected here for decades must
deal with the regulations that are
imposed by government entities,
Federal, State, and local, when
those who are here for the weekend
or a week violate those codes and
leave us with closed roads,
prospecting and panning areas that
are taken out of mineral entry, and
reclamation that is costly, not to
mention the liability. We love for
you to visit our beautiful state,
but please do it responsibly.
Prospector's
Code of Ethics
-
Respect other prospectors'
claims and do not work those
claims without their owners
permission.
-
Fill in your prospecting holes.
-
Appreciate and protect our
heritage of natural resources,
wildlife, fisheries, and private
property laws or ordinances
governing prospecting and
mining.

Be thoughtful, considerate, and
courteous to those around you at
all times. (For those of you who
feel the need to pack a gun,
please don't threaten anyone
with it.)
-
Build fires only in designated
or safe areas in accordance with
federal, state, and local laws.
-
Be careful with fuels and motor
oils. Do not fill pumps in the
water!
-
Remove and dispose of trash and
debris that you find. Pack it
in, pack it out. (sometimes we
make more money on the cans we
find than the gold!!!)

Have the necessary permits
and/or licenses on your person.
Club members using a club
site
need to have their membership
cards on them.
-
Do not remove stream bank
material, undermine vegetation
or woody dams, or discharge
excessive amounts of silt into
the waterway. (Highbankers are
required to use a tailings pond
to hold the silt and settle it
before it returns to the
waterway.)

Do not refuel motorized
equipment in the stream or allow
oil or fuel to drip onto the
ground or in the water.

Do not prospect in areas closed
to prospecting or mining

Respect private property and
don't hunt without the property
owners permission.

Fill in Your excavations from
treasure hunting.

Appreciate and protect our

What are the regulations concerning
small mining in Colorado?

Small
mining regulations in Colorado are basically
what you will find anywhere else.
There are, however, a few
regulations for various parts of the
state that are specific to that part
of the state. In general, you will
not need a permit for a dredge that
has a 4 inch nozzle or smaller.
Highbanking MUST discharge water
into a holding pond before being
released back into the waterway.
Panning, sluicing, and dry washing
are allowed in all parts of the
state that are not prohibited by
Federal, State or County law. That
being said, I suppose you might like
to know what restrictions are out
there that are not covered by
"general regulations". Here are the
ones I know about. |

Boulder
County - DO NOT PROSPECT IN BOULDER COUNTY unless you are VERY SURE you are on
public FEDERAL land. Boulder County has a complete ban on any type of
prospecting, including panning.
Don't even think about it. They are
aggressively enforcing the ban put into effect in 2006.
Arkansas River - The Arkansas River and its drainage has a limited open
season between April 1st to October
1st for most motorized equipment.
All motorized equipment that pumps
water from the Arkansas must have a BLM bond to work the Arkansas and its
tributaries. This bond is $25.00,
good for two years, and is non
refundable. Dredging is allowed
without further permitting up to 4
inch nozzle. Highbankers must
discharge into a holding pond before
water is returned to the river.
Dredging is confined to the high
water mark of the river. Dry
washing, panning and sluicing can be
done year round. Your bond can be
obtained from the BLM at the
Arkansas Headwaters
building in
Salida, Colorado. 2008: The BLM is
requiring a special bond for
HIGHBANKING in the Cache Creek area.
NO DREDGING IS ALLOWED HERE AT
ALL!!!!! Special bonding will
be $25.oo for 10 days of use.
Additional days, up to 10, can be
applied for at additional cost.

Arkansas River Drainage page
under Cache Creek for a link to the
forms. Highbanking along the
Arkansas must have a bonding permit
for EACH area you are highbanking.
Be aware
that the BLM will aggressively
ticket anyone undercutting the banks
in any manner. The
undercutting of trees has become a
serious problem along the Arkansas
and in the Cache Creek highbanking
area. Prospect responsibly,
and respect the land so that we do
not lose further rights as
prospectors. NEVER undercut
trees or banks in the pursuit of
$25.00, less OR more, worth of gold.
Areas are closed every year to
overzealous prospectors destroying
land, river banks, and forests.
I live in Colorado. Please, do
not destroy my home.
In addition, you MUST be aware of
where you are. Respect private
property and active or inactive
current claims. The local clubs can
